    I filed later and claimed my child, but haven’t received anything back yet. He has already received his income tax check in the beginning of February. I received a letter in the mail saying my taxes are being suited and delayed, and asking to prove that the child lives with me, and that I provide her support. Does this mean that he already claimed her? How can I find out? I tried calling IRS but they are closed on weekends 🙁

    It’s Monday! Call the IRS and ask them to help you today.

    In addition, make sure your court ordered custody agreement dictates who gets to claim your child as a tax dependent. If it doesn’t, go back to court for a modification so that there are no problems down the line. The IRS just cares if taxes are paid — they’re not a legal arm. The court is.

    What April Said. Also Yes from a legal standpoint take proof of who she lives with and provides for her. School Records, receipts, things of that nature. That is one reason not to get rid of receipts for about 7 or more years. If you do not have a child support/custody papers indicating who should claim your child. Go to court and get it done. Don’t worry about hireing a lawyer. Sometimes the courts do have good ones but If you think her father might try n screw you on things def look at getting one.

    [b]Guest [/b] gave you good advice. If you’re unsure when it comes to legal or tax issues, ask questions from the appropriate authorities and ask for help. You don’t need a lawyer to call the IRS or ask the court to name you or the other parent as the one who claims your child on your taxes. Getting things in writing always clarifies situations especially when there is a high chance of conflict like post divorce. Hope you got a tax refund! 😀
